उच्चतम न्यायालय ने उस याचिका को खारिज कर दिया जिसमें पुरी के प्रसिद्ध श्री जगन्नाथ मंदिर में अवैध उत्खनन और निर्माण कार्य का आरोप लगाया गया था। न्यायमूर्ति बी आर गवई और न्यायमूर्ति हिमा कोहली की अवकाशकालीन पीठ ने जनहित याचिका को खारिज कर दिया और कहा कि व्यापक जनहित में निर्माण गतिविधि आवश्यक है। शीर्ष अदालत ने कहा कि जनहित के लिए इस्तेमाल होने वाली जनहित याचिका (पीआईएल) जनहित के खिलाफ है। शीर्ष अदालत ने कहा कि हाल के दिनों में जनहित याचिकाएं दायर किए जाने का चलन बढ़ा है। गुणवत्तारहित जनहित याचिका दायर करने के चलन पर नाखुशी जताते हुए उच्चतम न्यायालय ने कहा कि यह कानून का दुरुपयोग है।
शीर्ष अदालत पुरी के श्री जगन्नाथ मंदिर में ओडिशा सरकार द्वारा अवैध उत्खनन और निर्माण कार्य किए जाने का आरोप लगाने वाली, अद्धेंदु कुमार दास और अन्य की याचिका पर सुनवाई कर रही थी। याचिका के अनुसार, राज्य की एजेंसियां प्राचीन स्मारक एवं पुरातत्व स्थल और पुरावशेष अधिनियम, 1958 की धारा 20ए का घोर उल्लंघन कर रही हैं। याचिका में आरोप लगाया गया है कि ओडिशा सरकार अनधिकृत निर्माण कार्य कर रही है जो प्राचीन मंदिर की संरचना के लिए गंभीर खतरा है।
