नयी दिल्ली। दिल्ली हाईकोर्ट ने आम आदमी पार्टी के नेता एवं दिल्ली के स्वास्थ्य मंत्री सत्येंद्र जैन की याचिका को खारिज कर दिया। इस याचिका में निचली अदालत के उस आदेश को चुनौती दी गयी थी जिसमें उनके खिलाफ धन शोधन (मनी लॉन्ड्रिंग) मामले को किसी अन्य अदालत में दायर किये जाने का आदेश दिया गया था। दिल्ली हाईकोर्ट के न्यायाधीश योगेश खन्ना ने दोनों पक्षों की दलीलें सुनने के बाद कहा कि मुख्य जिला एवं सत्र न्यायालय के न्यायाधीश, राउज एवेन्यू अदालत की ओर से जारी किये गये आदेश में कुछ भी असंवैधानिक नहीं है। अदालत ने सभी तथ्यों की जांच पडताल के बाद ही आदेश पारित किया है।
मंत्री जैन के वकील ने दिल्ली उच्च न्यायालय में मुख्य जिला और सत्र न्यायाधीश विनय कुमार गुप्ता के 23 सितंबर को दिए गए आदेश को चुनौती देने वाली याचिका दायर की थी। सत्र न्यायाधीश ने अपने आदेश में विशेष न्यायाधीश गीतांजलि गोयल और विकास ढल द्वारा मंत्री जैन के खिलाफ मनी लॉन्ड्रिंग की रोकथाम कानून के प्रावधानों के तहत दर्ज किये गये मामले को स्थानांतरित किये जाने का आदेश दिया गया था।
प्रवर्तन निदेशालय (ईडी) की स्थानांतरण याचिका को मुख्य जिला और सत्र न्यायाधीश ने स्वीकार किया था। अदालत ने यह स्वीकृति ईडी और बचाव पक्ष दोनों द्वारा पेश तथ्यों को सुनने के बाद दिया था। गौरतलब है कि ईडी ने 30 मई को श्री जैन को मनी लॉन्डिरिंग रोकथाम के लिए बने कानून का उल्लंघन करने के आरोप में गिरफ्तार किया था और तभी से वह तिहाड़ जेल में न्यायिक हिरासत में हैं।
