दिल्ली उच्च न्यायालय ने मंगलवार को केंद्र को बेंचमार्क विकलांगता (विकलांगता मापदंड) से ग्रस्त व्यक्तियों के लिए चिकित्सा महाविद्यालयों में आरक्षित रिक्त सीटों को उस पैमाने पर खरा नहीं उतरने वाले दिव्यांगों (विकलांगों) से भरने के एक प्रतिवेदन पर केंद्र से नीतिगत निर्णय लेने को कहा।
मुख्य न्यायाधीश सतीश चंद्र शर्मा की अगुवाई वाली एक पीठ ने केंद्र से विकलांगता मापदंड पर खरा नहीं उतरने वाले एक एमबीबीएस प्रत्याशी की याचिका पर जवाब मांगा है जिसने दिव्यांगों के लिए लिए आरक्षित खाली सीटों में एक पर चिकित्सा महाविद्यालय में प्रवेश देने की मांग की है। चलने-फिरने में स्थायी रूप से असमर्थ प्रत्याशी ने नीट-यूजी 2022 में 96.06 पसेंटाइल हासिल किया था और उसे विकलांगता मापदंड से 40 फीसदी कम पाया गया था। यह मापदंड शिक्षा में आरक्षण के दावे के लिए तय किया गया है।
याचिकाकर्ता ने कहा कि बेंचमार्क विकलांगता से ग्रस्त उम्मीदवारों के चिह्नित सीट को सामान्य श्रेणी की सीट में तब्दील कर उसे किसी गैर विकलांग को आवंटित करना अनुचित होगा। न्यायमूर्ति शर्मा और न्यायमूर्ति सुब्रमण्यम की पीठ ने कहा, केंद्र को याचिकाकर्ता के प्रतिवेदन पर निश्चिम ही गौर करना चाहिए और वह कोई भी नीतिगत निर्णय लेने के लिए स्वतंत्र होगा। अदालत ने केंद्र से अपना जवाब दाखिल करते हुए अपना रूख बताने को कहा है। उसने राष्ट्रीय परीक्षा एजेंसी और राष्ट्रीय चिकित्सा आयोग से भी इस अर्जी पर जवाब मांगा है।
