वेदांता समूह को झटका देते हुए उच्चतम न्यायालय ने बुधवार को उड़ीसा उच्च न्यायालय के 2010 के फैसले को बरकरार रखा जिसमें राज्य सरकार द्वारा विश्वविद्यालय स्थापित करने के लिए करीब 6,000 एकड़ जमीन के अधिग्रहण की प्रक्रिया को रद्द करने का फैसला किया गया था। राज्य सरकार से नाखुशी जताते हुए शीर्ष अदालत ने कहा कि वेदांता को ‘अनुचित लाभ’ पहुंचाया गया और राज्य सरकार द्वारा प्रस्तावित संपूर्ण अधिग्रहण की कार्यवाही ‘पक्षपात से प्रभावित थी।’ न्यायमूर्ति एम आर शाह और न्यायमूर्ति कृष्ण मुरारी की पीठ ने अनिल अग्रवाल फाउंडेशन पर पांच लाख रुपये का जुर्माना भी लगाया जिसे छह सप्ताह के भीतर शीर्ष अदालत के रजिस्ट्रार के पास जमा कराना होगा।
पीठ ने कहा, यह सराहनीय नहीं है कि सरकार ने एक ट्रस्ट/कंपनी के पक्ष में इस तरह के अनुचित लाभ की पेशकश क्यों की। इस प्रकार, राज्य सरकार द्वारा प्रस्तावित संपूर्ण अधिग्रहण की कार्यवाही पक्षपातपूर्ण थी और भारत के संविधान के अनुच्छेद 14 का उल्लंघन हुआ। शीर्ष अदालत ने तीखी टिप्पणी करते हुए कहा कि अधिग्रहण की पूरी प्रक्रिया वेदांता फाउंडेशन के इशारे पर शुरू की गई। वेदांता फाउंडेशन का नाम बाद में अनिल अग्रवाल फाउंडेशन कर दिया गया था।
