डीम्स विश्वविद्यालय जबतक सरकार के नियंत्रण में नहीं है, तबतक आरटीआई कानून से है वह बाहर: दिल्ली हाईकोर्ट

दिल्ली उच्च न्यायालय ने कहा है कि जबतक कोई ‘डीम्ड’ (मानद) विश्वविद्यालय सरकार के नियंत्रण में नहीं है या उसके द्वारा वित्तपोषित नहीं है, तबतक वह सूचना के अधिकार कानून (आरटीआई) के दायरे में आने वाला ‘सार्वजनिक प्राधिकार’ नहीं है। उच्च न्यायालय का यह आदेश एक आरटीआई आवेदक की याचिका पर आया है। याचिकाकर्ता ने विनायक मिशन यूनिवर्सिटी (डीम्ड विश्वविद्यालय) से 2007 और 2011 के बीच दूरस्थ शिक्षा के माध्यम से विज्ञान स्नोतकोत्तर (रसायन विज्ञान) करने वाले विद्यार्थियों के क्रमांक, नाम, उनके पिता के नाम समेत उनके बारे में विवरण की मांग को लेकर यह याचिका दायर की थी।

मुख्य सूचना आयुक्त (सीआईसी) ने याचिकाकर्ता को इस आधार पर सूचना देने से इनकार कर दिया था कि यह संस्थान ‘सार्वजनिक प्राधिकार’ नहीं है तथा जो सूचनाएं मांगी गयी है वह उसके अंदरूनी प्रशासन से जुड़ी हैं। न्यायमूर्ति सुब्रमण्यम प्रसाद ने कहा कि सीआईसी के फैसले में दखल देने का कोई कारण नहीं है। न्यायमूर्ति प्रसाद ने कहा कि आरटीआई कानून का गैर सरकारी संगठनों समेत ऐसे निकायों से संबंध है जो सरकार के स्वामित्व, नियंत्रण में या काफी हद तक वित्तपोषित हैं और चूंकि कोई विश्वविद्यालय, विश्वविद्यालय के रूप में मान्य है तो महज इतना भर के लिए उसे इस कानून के तहत सार्वजनिक प्राधिकार नहीं समझा जाएगा। उच्च न्यायालय ने कहा, ”बंबई उच्च न्यायालय की पूर्ण पीठ ने भी हाल में व्यवस्था दी कि चूंकि कोई विश्वविद्यालय यूजीसी कानून की धारा तीन के तहत जारी अधिसूचना से विश्वविद्यालय के रूप में मान्य है तो बस इतना भर के लिए उसे (आरटीआई) कानून के तहत सार्वजनिक प्राधिकार नहीं समझा जाएगा। याचिकाकर्ता ने दलील दी थी कि संरक्षक और ‘सार्वजनिक प्राधिकार’ होने के नाते विश्वविद्यालय अनुदान आयोग (यूजीसी) को उसे सूचना उपलब्ध कराने के लिए बाध्य किया जाना चाहिए। लेकिन दिल्ली उच्च न्यायालय ने कहा कि याचिकाकर्ता ने जो सूचना मांगी है वह ‘निजी’ है तथा उसे आरटीआई कानून के तहत छूट प्राप्त है, दूसरा उसने ऐसा कुछ नहीं सामने रखा है जिससे यह संकेत मिले कि सार्वजनिक हित निजता की चिंता से ऊपर है।
