दिल्ली उच्च न्यायालय ने कहा है कि प्रवर्तन निदेशालय (ईडी) के पास सिर्फ धन शोधन रोकथाम अधिनियम (पीएमएलए) के तहत अपराध की जांच करने की शक्ति है और जांच एजेंसी यह अनुमान नहीं लगा सकती कि एक अपराध हुआ है। उच्च न्यायालय ने कहा कि जिस अपराध के बारे में अनुमान लगाया गया है, उसकी अवश्य ही जांच करनी होगी और उस सिलसिले में कानूनी रूप से अधिकृत प्राधिकारों द्वारा सुनवाई करनी होगी। साथ ही, ईडी यह अपराध कथित तौर पर हुए होने की जांच करने की शक्ति नहीं हथिया सकती है। अदालत ने कहा, इस बात पर जोर दिये जाने की जरूरत है कि पीएमएलए ईडी को सिर्फ धारा 3 के तहत हुए अपराधों की जांच करने की शक्तियां देता है। जांच करने की इसकी शक्तियां इस धारा में परिभाषित धन शोधन के अपराध तक सीमित हैं।
न्यायमूर्ति यशवंत वर्मा ने 24 जनवरी को जारी 111 पन्नों के एक फैसले में कहा, अनुमानित अपराध की अवश्य जांच करनी होगी और इसकी सुनवाई इस सिलसिले में कानून द्वारा अधिकार प्राप्त प्राधिकारों द्वारा करनी होगी। उच्च न्यायालय ने कहा, ”इस तरह के अपराधों की जांच और सुनवाई का प्राथमिक कार्य उन स्वतंत्र विधानों के तहत गठित प्राधिकारों में निहित है…किसी भी मामले में, यह (ईडी) खुद से यह तय नहीं कर सकती कि एक खास तथ्यों का समूह एक अनुमानित अपराध का साक्ष्य है, जिसके आधार पर पीएमएलए के तहत कार्रवाई शुरू करने की जरूरत है। प्रकाश इंडस्ट्रीज लिमिटेड और प्रकाश थर्मल पावर लिमिटेड की दो अलग-अलग याचिकाओं पर उच्च न्यायालय का यह फैसला आया है। यह आरोप है कि दोनों कंपनियों ने कोयला ब्लॉक खरीदने के लिए अपनी कुल संपत्ति के बारे में सही आंकड़े नहीं दिये थे।
