सुप्रीम कोर्ट ने कहा कि पत्नी पर पति द्वारा की गई क्रूरता के संबंध में मृत्यु पूर्व दिए गए पत्नी के बयान साक्ष्य अधिनियम के तहत भारतीय दंड संहिता की धारा 498 ए के तहत आरोपों की सुनवाई के दौरान स्वीकार्य होंगे। प्रधान न्यायाधीश न्यायमूर्ति एनवी रमण की अगुवाई वाली पीठ ने हालांकि कहा कि साक्ष्य स्वीकार किए जाने से पहले कुछ आवश्यक शर्तें पूरी की जानी होंगी। शीर्ष अदालत ने कहा कि पहली शर्त यह है कि मामले में उसकी मृत्यु का कारण प्रश्न के दायरे में आना चाहिए। सुप्रीम कोर्ट ने और भी शर्तों का जिक्र किया।
न्यायालय ने केरल उच्च न्यायालय के एक आदेश को चुनौती देने वाले एक व्यक्ति की याचिका पर यह टिप्पणी की। अदालत ने अपने आदेश में उसे भारतीय दंड संहिता की धारा 304बी के तहत बरी कर दिया था, लेकिन धारा 498 ए के तहत दोषी करार दिया था।
