उच्चतम न्यायालय शिवसेना के मुख्य सचेतक सुनील प्रभु की उस याचिका पर शाम पांच बजे सुनवाई करने के लिए बुधवार को राजी हो गया, जिसमें महाराष्ट्र के राज्यपाल द्वारा उद्धव ठाकरे नीत महा विकास आघाडी (एमवीए) सरकार को बृहस्पतिवार को विधानसभा में शक्ति परीक्षण कराने के लिए दिए गए निर्देश को चुनौती दी गयी है। न्यायमूर्ति सूर्यकांत और न्यायमूर्ति जे बी परदीवाला की अवकाशकालीन पीठ ने वरिष्ठ अधिवक्ता ए एम सिंघवी की उन दलीलों पर संज्ञान लिया कि राज्यपाल भगत सिंह कोश्यारी द्वारा एमवीए सरकार को बृहस्पतिवार सुबह 11 बजे बहुमत साबित करने के लिए दिए गए आदेश के मद्देनजर मामले पर तत्काल सुनवाई की आवश्यकता है।

पीठ ने कहा, ”हम शाम पांच बजे सुनवाई करेंगे। कृपया यह सुनिश्चित करिए कि संबंधित पक्षों को शाम तीन बजे तक कागजात दे दिए जाए। सिंघवी ने कहा कि शक्ति परीक्षण में उन विधायकों के नाम शामिल नहीं किए जा सकते जो ”दागी” हैं। इससे पहले उच्चतम न्यायालय ने महाराष्ट्र विधानसभा के उपाध्यक्ष द्वारा जारी अयोग्यता नोटिस के खिलाफ शिवसेना के बागी विधायकों को राहत प्रदान करते हुए सोमवार को कहा था कि संबंधित विधायकों की अयोग्यता पर 11 जुलाई तक फैसला नहीं लिया जाना चाहिए। इसके साथ ही शीर्ष अदालत ने अयोग्यता नोटिस की वैधता को चुनौती देने वाले बागी विधायकों की याचिकाओं पर राज्य सरकार एवं अन्य से जवाब तलब किया।
