दिल्ली उच्च न्यायालय ने अतिक्रमण पर पूर्ण विराम सुनिश्चित करने के लिए ‘तहबाजारी’ दुकानों को नगर निगम द्वारा चिह्नित स्थानों पर भेजने की पूर्ण योजना की मांग संबंधी एक याचिका पर निगम अधिकारियों से जवाब मांगा है। न्यायमूर्ति सिद्धार्थ मृदुल और न्यायमूर्ति अमित शर्मा की पीठ ने एक लंबित याचिका के सिलसिले में दिये गये एक आवेदन पर यह नोटिस जारी किया । इस आवेदन में यहां करोल बाग में फुटपाथ पर कियोस्क जैसी स्थायी संरचना के निर्माण को कथित रूप से अनुमति देने को लेकर संबंधित अधिकारियों पर अवमानना की कार्रवाई की मांग की गयी है।
याचिकाकर्ता सामाजिक कार्यकर्ता अमित साहनी ने आवेदन में कहा कि करोल बाग में अजमल खान पार्क के आसपास फुटपाथ पर ‘तहबाजारी दुकानों’ का निर्माण पहले रोक दिया गया था क्योंकि उच्च न्यायालय की एक खंडपीठ ने उत्तरी दिल्ली नगर निगम द्वारा किये गये निर्माण पर 19 अप्रैल को स्थगन लगा दिया था। लेकिन याचिकाकर्ता ने कहा कि प्रशासन करोल बाग टर्मिनल, देशबंधु गुप्ता रोड के फुटपाथ पर ऐसा ही निर्माण कराने लगा जो इस अदालत के पिछले आदेश की अवमानना जैसा है। याचिकाकर्ता ने कहा कि उन्होंने देशबंधु गुप्ता मार्ग पर नयी जगह दुकानों के निर्माण को लेकर दिल्ली जलबोर्ड और लोक निर्माण विभाग को आवेदन दिया और दोनों ही विभागों ने पुलिस में शिकायत कर नयी जगह पर दुकानों के निर्माण का विरोध किया।
अदालत ने इस मामले की अगली सुनवाई की तारीख 18 जुलाई तय की है। पहले उच्च न्यायालय ने अवमानना याचिका पर नोटिस जारी किया था तथा इलाके में ऐसे और निर्माण पर रोक लगा दी थी। अपनी याचिका में साहनी ने कहा कि निर्माण पैदलयात्रियों की आवाजाही में रुकावट पैदा करते हैं जो उच्च न्यायालय के मार्च, 2018 के आदेश का उल्लंघन है। उच्च न्यायालय ने मार्च , 2018 में निगमों को यह सुनिश्चित करने का निर्देश दिया था कि पदयात्रियों की आवाजाही में रुकावट डालने वाली कोई स्थायी/अर्धस्थायी संरचना फुटपाथ पर न हो।
