सुप्रीम कोर्ट ने राजद्रोह कानून पर बुधवार को रोक लगाने के साथ ही केंद्र और राज्य सरकारों को भारतीय दंड संहिता (आईपीसी) की धारा 124-ए के तहत प्राथमिकी दर्ज नहीं करने के आदेश दिए। मुख्य न्यायाधीश एनवी रमन की अध्यक्षता वाली तीन न्यायाधीशों की पीठ ने राजद्रोह कानून की संवैधानिक वैधता को चुनौती देने वाली याचिकाओं पर सुनवाई के बाद अपने अंतरिम आदेश में कहा कि आईपीसी की धारा 124-ए के तहत सभी कार्रवाई स्थगित की जाती हैं। पीठ ने कहा है कि धारा 124-ए के तहत जेल में निरुद्ध लोग राहत और जमानत के लिए सक्षम अदालतों का रुख कर सकते हैं।
पीठ ने केंद्र से राजद्रोह कानून पर पुनर्विचार करने के लिए भी कहा है। पीठ ने स्पष्ट किया कि राजद्रोह कानून पर पुनर्विचार होने तक इस प्रावधान के तहत कोई मामला दर्ज नहीं किया जाएगा और न ही किसी प्रकार की जांच की जाएगी। संबंधित मामले की अगली सुनवाई जुलाई के तीसरे सप्ताह में होगी। एडिटर्स गिल्ड ऑफ इंडिया, पूर्व मेजर जनरल एस जी वोम्बतकेरे, तृणमूल कांग्रेस सांसद महुआ मोइत्रा, पत्रकार अनिल चमड़िया तथा अन्य ने राजद्रोह कानून की संवैधानिक वैधता को शीर्ष न्यायालय में चुनौती दी है। वरिष्ठ पत्रकार एवं पूर्व केंद्रीय मंत्री अरुण शौरी ने भी अपनी याचिका में कहा है कि राजद्रोह कानून संविधान के अनुच्छेद 14 और 19(1)(ए) का उल्लंघन करता है।
